X.M. (“Mike”) FRASCOGNA, JR.is the senior partner in the law firm of Frascogna Courtney, PLLC which was established in 1972 in Jackson, Mississippi. Frascogna has over 42 years of experience as a civil trial attorney engaged in an extensive general litigation and transactional practice representing both plaintiffs and defendants in a wide variety of cases including the following areas: international litigation and business transactions, complex commercial litigation, mass tort litigation, transactions involving real estate, intellectual property, oil & gas, securities, media rights, insurance and all aspects of music, movie, television and book property rights, celebrity rights and all forms of complex negotiations. He has served as an Adjunct Professor of Law at Mississippi College School of Law since 1978, teaching courses in negotiation and entertainment & sports. Frascogna has maintained a Martindale Hubbell peer review AV® Preeminent rating continuously since 1993. Selected by the Mississippi Business Journal as one of the Top Ten Leaders in Law for 2013 and named as the Lawyer of the Year by Mississippi College School of Law for 2013.
Frascogna remains active in alternative dispute resolution serving on the panel of arbitrators and mediators of the American Arbitration Association. He has arbitrated and mediated foreign and domestic commercial disputes and has served as a Special Master to numerous circuit courts throughout Mississippi. Frascogna assisted the Federal Bureau of Investigation in a hostage negotiation incident which he brought to a successful conclusion. He served as lead counsel for the Complainant in a case involving several multinational parties which was litigated in the Permanent Court of Arbitration at The Hague, Netherlands.
Frascogna has received extensive training as an arbitrator and mediator attending national seminars and programs, notably, Pepperdine University School of Law, Straus Institute for Dispute Resolution, Advanced Mediation Skills Conference, William Mitchell College of Law, Special Masters Conference and the Harvard Law School, Program of Instruction in Negotiation.
He is admitted to practice before the U.S. Supreme Court, U.S. Court of Appeals, Fifth Circuit and U.S. District Court, Southern District of Mississippi and all state courts of Mississippi. Frascogna served as a Bar Commissioner of the Mississippi State Bar Association from 1994- 1997. Frascogna is a charter member of the National Academy of Court Appointed Masters, a member of the American Bar Association (Forum Committee on Entertainment and Sports Law), the Mississippi Bar Association and the American Arbitration Association. He is also a voting member of the National Academy of Recording Arts and Sciences, the organization that annually gives the GRAMMY® Awards.
Frascogna is a graduate of Mississippi State University (BS -1969, MA - 1970) and Mississippi College (MBA - 1976, MSS -1982) and Mississippi College School of Law (JD with distinction - 1972). He was the recipient of the first honorary LLM degree given by Mississippi College School of Law in 2007.
Frascogna has been an Adjunct Professor of Law at Mississippi College School of Law since 1978 where he teaches an innovative course in negotiation to third-year students and also teaches an intense survey course in Entertainment Law each summer. He teaches Entertainment Law as a visiting Adjunct Professor at the Robert C. Khayat School of Law at the University of Mississippi. In addition, Frascogna lectures at CLE seminars on the topics of negotiation and entertainment law. He frequently addresses graduate school classes on negotiating theory and strategy.
